This Website shall not be responsible for any items sold by Auction that cause injuries to any person or party, for any damage to items during transit or during the inspection period, nor for misrepresentations and/or breaches of contract by either buyer and/or seller. This website shall not be responsible for the cost of procurement of substitute goods or any losses resulting from any goods purchased or obtained.
This website assumes no liability for the content of the listings nor warrants that this website will be constantly available, or the information is complete, true and accurate or non-misleading. Any dispute for the sale of any Auction/Product or Classified shall be resolved between the Buyer and Seller and without the participation of Gasmotive.
In addition, note that there are risks of dealing with underage persons or people acting under false pretense. Rights To Suspend or Terminate. You agree that this web-site, in its own discretion, may terminate or suspend any listing or use of the website immediately and without notice if (A) We believe that you are not abiding by the general rules of this web-site (B) You have repeatedly broken a certain term (C) You have listed a suspicious item or an item that is falsifying to the buyer as to what the item is and its condition from the photos and description on the website (D) We believe you to be a nonpaying bidder (E) We believe you have not paid the required End of Sale Transaction fees applicable to an Item you purchased (F) We believe you have deliberately closed a listing and or settled a sale outside of Gasmotive in order to avoid paying any required fees (G) If you have setup a store and or have been approved for a credit account that has gone over the DEBIT LIMIT (H) You the seller have received payment for an item but have not shipped it or not shipped within a reasonable time frame (I) You cannot bid on your own Auction Lot. You cannot bid on an Auction Lot of someone you know, nor can you have a friend, or someone connected to you bid on your Auction Lot unless they have a genuine intention of purchasing the product. If this occurs you will be liable to us and indemnify us for any losses or costs, including reasonable legal fees (J) We believe you to be using the site to commit any act of fraud (K) We believe you are using the site for purposes of promoting unsolicited advertising or sending spam (L) We believe you are using the site in order to collect identity information, authentication credentials, or other information (M) We suspect you are using the site in any way that harms minors (N) We suspect you have attempted to setup a new account and/or appear to be a new user after your account has been cancelled (O) We believe you have entered personal contact information such as names, addresses, phone numbers or email addresses in the listing details/description (P) Use our messaging system to first contact the seller for any information regarding the item you're interested in. Phone numbers can be exchanged through messaging if both parties agree.
In most cases when we suspect foul play, we will suspend your account/listing whilst we investigate further. If our investigation is conclusive then your account with us will be terminated. Your Conduct. You are solely responsible for the contents of your actions through this website. You must ensure that your participation in the selling or buying of items does not violate any applicable laws or regulations. By this we mean that you must check that you entitled to sell or buy the relevant item and that you are not prohibited from doing so by Australian Consumer laws and regulations. You must not transmit through the service any unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene or otherwise objectionable material. You must also not transmit any material that encourages conduct that could constitute a criminal offence, give rise to civil liability or otherwise violate any applicable law or regulation. Membership. Membership to this website is only available to those you can form a legally binding contract. This website does not permit minors (under18) to register. If any member fails to sign up with their correct age the account will be terminated immediately.
Account Setup. The site is available to all users aged 18 years and over. Upon setup you will be asked to provide the following details in order to buy and sell products on this website. Name, Address, Date of Birth, Phone Number, Email Address and PayPal email address. These details must be true, accurate and non-misleading. Voucher Codes. If a voucher code is available through the site but is not used by the buyer or seller for any reason, no refunds for site fees will be given.
